Terms of Use
Last updated: October 11, 2026
These terms are a simple agreement between you and Earthia One A.C. ("we", "us"), the operator of Moonlit Lullabies (the "Service"). By using the Service, as a guest or with an account, you agree to them. If you don't agree, please don't use the Service.
1. Songs are made by artificial intelligence
Every song's lyrics, music and voice are generated automatically by artificial intelligence (AI) systems, some run by other companies. No person writes or reviews each song before you hear it.
AI can make mistakes. It can produce words, sounds or ideas that are inaccurate, odd, or unsuitable. All songs are provided "as is". We do not take responsibility for the content of any song, or for how it is used.
2. Please check every song before playing it to a child
We use two safety checks: a word filter and an AI reviewer that looks at every song before music is made. Please read AI & Safety for details. These checks reduce risk, but they can't catch everything.
You agree to read the lyrics and listen to each song yourself before playing it to any child. You alone decide whether a song is right for your child. If you find something inappropriate, stop playing it and tell us at earthiaone@gmail.com.
3. Not professional advice
The Service is for gentle entertainment and bedtime comfort only. It is not medical, psychological, therapeutic, sleep, developmental or educational advice. Songs about fears or feelings are not a replacement for a doctor, therapist or other professional. If you are worried about your child's health, sleep or wellbeing, please talk to a qualified professional.
Our blog articles and guides draw on online sources, with tips and suggestions thoughtfully filtered for relevance to families. This selection does not mean that experts have reviewed every article or that every recommendation is scientifically verified. Information may be incomplete, outdated or mistaken. Please do your own research, check the sources, and consider your child's age and individual needs before following any suggestion. These articles and guides are general information, not professional advice or a substitute for a qualified professional's guidance.
4. Who can use the Service
The Service is for adults. You must be at least 18 years old (or the age of majority where you live) and a parent, guardian or caregiver who plays songs to children. Children must not create accounts or use the Service on their own.
5. What you enter
You are responsible for everything you enter, such as children's names, ages and special topics. Only enter information you have the right to share. Don't use the Service to create anything harmful, hateful, sexual, violent, illegal or unsuitable for children, and don't try to get around our safety checks. We may refuse, remove or block content or requests at our discretion.
6. Using your songs
You may download your songs and play them for personal, non-commercial family use. You may not sell, license or commercially distribute them.
Laws about who owns AI-generated content are unclear and differ between countries. We do not promise that you, or anyone, owns copyright in any song. Songs may by chance resemble other works. You use them at your own risk. Our AI providers' own terms may also apply.
7. Free limits and fair use
Guests and account holders may create a limited number of songs, as shown in the app. We may change these limits, the styles we offer, or other features. We may suspend or close accounts that misuse the Service, harm others, or break these terms.
8. We can change, pause or stop the Service
We may change, pause or permanently stop the Service, or any part of it, at any time, with or without notice. That includes deleting stored songs after the Service ends. Please download any songs you want to keep.
The Service is currently free. If we offer paid plans in the future and stop a paid service before the end of a period you paid for, we will refund the unused part of what you paid. This is our only obligation to you if the Service stops.
9. No warranties
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. That includes fitness for a particular purpose, accuracy, safety of content, non-infringement, and uninterrupted or error-free operation.
10. Limits on our liability
To the fullest extent the law allows, Earthia One A.C. and its people are not liable for any indirect, incidental, special, consequential or punitive damages. We are also not liable for loss of data, songs, or goodwill, or for any harm arising from AI-generated content or from playing songs to anyone.
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50.
11. Your responsibility to us
You agree to defend and compensate Earthia One A.C. for any claims, losses or costs (including reasonable legal fees) caused by your misuse of the Service, the content you enter, or your breaking these terms.
12. Your legal rights still apply
Some countries, including EU member states, give consumers rights that cannot be limited by contract. Nothing in these terms takes away those rights. If any part of these terms is not enforceable, the rest still applies.
13. Disagreements
If you have a problem, please email us first at earthiaone@gmail.com, and we will try to resolve it informally within 30 days. If that doesn't work, any dispute will be handled by the competent courts where Earthia One A.C. is based. If you live in the EU, you may also bring a claim in the courts of your home country and use EU consumer dispute services.
14. Changes to these terms
We may update these terms. We'll change the "last updated" date, and for important changes we'll show a notice in the app. If you keep using the Service after an update, you accept the new terms.
